1. Purpose
These terms govern the supply of shared hosting, WordPress hosting, virtual and dedicated servers, professional email and domain name registration services by Smiley Hoster SARL to the customer.
Ordering a service constitutes unreserved acceptance of these terms, the privacy policy and, for domain names, the rules of the registry concerned.
2. Prices and renewal
Prices are shown in dirhams, all taxes included. The renewal price is shown next to the first-period price, on the plan page and in the cart, before payment.
Renewal is automatic unless cancelled at least seven days before the due date. A renewal notice is sent thirty days and then seven days before the charge.
3. Activation and migration
Shared and WordPress hosting are active immediately after payment. Virtual servers are delivered within one hour, dedicated servers within twenty-four business hours.
Migration of an existing site is handled free of charge for a site under 30 GB, on cPanel, WordPress and VPS plans. Above that, a quote is provided before any work.
4. Availability and compensation
Smiley Hoster commits to monthly availability of 99.9%, excluding planned maintenance announced at least seventy-two hours in advance.
If this commitment is not met, the customer obtains on request a credit equal to 5% of the monthly fee per hour of unavailability, capped at the monthly fee of the service concerned.
5. Customer obligations
The customer is responsible for the published content, the lawfulness of their data processing and the confidentiality of their credentials. They keep the applications they install themselves up to date.
Sending unsolicited email, hosting manifestly unlawful content and any use that harms the stability of shared servers are prohibited.
6. Termination and refund
Hosting is refunded in full on request within thirty days of the first order. Domain names, once registered with the registry, are not refundable.
In the event of a serious breach by the customer, the service may be suspended after a formal notice left unanswered for forty-eight hours, except in a security emergency.
7. Data and governing law
The customer obtains a complete copy on request, in a standard format, at any time during the contract and for thirty days after its end.
These terms are governed by Moroccan law. Any dispute not resolved amicably falls under the courts of Casablanca.
